About Digital Signature Certificate (DSC)


1. What is Digital Signature.?

Digital Signature is a mathematical scheme for authenticity of a digital message or document. A valid digital signature gives a recipient, reason to believe that the message was created by a known sender, and that sender cannot deny having sent the message, and the message was not altered in transit.

Currently DSC is made on SHA-2 function.

SHA stands for Secure Hash Algorithm. SHA is a set of cryptographic hash functions designed by the National Security Agency (NSA).

Misconceptions about DSC

Generally, people think DSC contains scan copy of their signature, this is wrong. The DSC works on cryptographic hash function designed by NSA.

Benefits of DSC

There are so many benefits of DSC but the most important benefit is that once we have signed any document with DSC it can't be tampered or changed.

Example: - While using DSC on MCA e-form, if user need to modify e-form, all DSCs attached in the e-form are cleared.


2. Who issues DSC

Controller of Certifying Authority (CCA)

The Information Technology Act, 2000 empowers CCA to issue a license and regulate the working of Certifying Authorities.

The CCA has been appointed by the Central Government.

Certifying Authority (CA)

CA means a person who has been granted a license from the CCA to issue a DSC.

A licensed CA issues the DSC.

Registration Authority (RA)

Certifying Authority appoints Registration Authority who deals with applicant of digital signature.

Classes of DSC
There are following Classes of DSC:-

Class 1 DSC- These certificates are issued to individuals/private subscribers. These certificates shall confirm that user's name (or alias) and e-mail address form an unambiguous subject within the Certifying Authorities database.

Class 2 DSC- These certificates are made on the identity of a person verified against a trusted pre-verified database like Voter ID Card, Passport, Driving License, PAN Card, Post Office ID Card and AADHAAR Card etc.

These certificates are issued for both business personnel and private individuals use.

Class 3 DSC- These certificates are issued to individuals as well as organizations. As these are high assurance certificates, primarily intended for e-commerce applications, they shall be issued to individuals only on their personal (physical) appearance before the Certifying Authorities.


Note: Every website, on which DSC is to be used, provides the information which class of DSC will be accepted.


3. Legal recognition of the DSC

Section 5
Legal recognition of digital signatures

Where any law provides that information or any other matter shall be authenticated by affixing the signature or any document shall be signed or bear the signature of any person (Hence, notwithstanding anything contained in such law, such requirement shall be deemed to have been satisfied, if such information or matter is authenticated by means of digital signature affixed in such manner as may be prescribed by the Central Government.

Explanationβ€”for the purposes of this section, "signed", with its grammatical variations and cognate expressions, shall, with reference to a person, mean affixing of his hand written signature or any mark on any document and the expression "signature" shall be construed accordingly

Section 68
Power of controller to give directions

(1) The Controller may, by order, direct a Certifying Authority or any employee of such authority to take such measures or cease carrying on such activities as specified in the order if those are necessary to ensure compliance with the provisions of this Act, rules or any regulations made there under.

(2) Any person who fails to comply with any order under sub-section (1) shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding three years or to a fine not exceeding two lakhs rupees or both.

Section 71
Penalty formisrepresentation

(1) Whoever makes any misrepresentation to, or suppresses any material fact from, the Controller or the Certifying Authority for obtaining any license or DSC, as the case may be, shall be punished with imprisonment for a term which may extend to two years, or which fine which may extend to one lakhs rupees, or both.

Section 73
Penalty for publishing Digital Signature Certificate false in certain particulars

(1) No person shall publish a Digital Signature Certificate, or otherwise make it available to any other person with the knowledge that-

(a) The Certifying Authority listed in the certificate has not issued it; or

(b) The subscriber listed in the certificate has not accepted it; or

(c)The certificate has been revoked or suspended, unless such publication is for the purpose of verifying a digital signature created prior to such suspension or revocation.

(2) Any person who contravenes the provisions of sub-section (1) shall be punished with imprisonment for a term which may extend to two years, or with fine which may extend to one lakhs rupees, or both.

Section 74
Publication for fraudulent purpose

Whoever knowingly creates publishes or otherwise makes available a Digital Signature Certificate for any fraudulent or unlawful purpose shall be punished with imprisonment for a term which may extend to two years, or with fine which may extend to one lakhs rupees, or both.


Note: Some new section also inserted & amended in The Indian Evidence Act 1872 and Indian Penal Code 1860.


4. USB Tokens

USB token is a hardware device to store DSC.

The device does not have any expiry like digital signature, means it can be reused.

USB token ensures that nobody can have unauthorized access of the DSC of a user, because when anybody wants to use the DSC, it asks for password to access the contents of the USB token.

The USB tokens are developed on the technology called FIPS (The Federal Information Processing Standard). FIPS level- 2 & 3 technologies token are used nowadays.
